Terms of Service

About these Terms

These Terms are an agreement between you and Pixeltron, Inc. ("Pixeltron", "we"). They cover the Pixeltron website, the Pixeltron apps, Pixeltron Studio and every Pixeltron service. By creating an account or using Pixeltron you agree to them.

These policies are part of these Terms: the Privacy Policy, the User Content and Community Policy, the Creator Terms, the Copyright and DMCA Policy, the Rewards, Credits, and Payout Terms, the Asset and AI Content Terms, and the Parental Controls and Minor Safety policy. The Privacy Policy explains how we handle your information, including that your friends and the members of a party you are in can see the premium avatar you wear.

If you use Pixeltron for a business, for example to advertise, you agree on behalf of that business, and the Advertiser Terms also apply.

Who can use Pixeltron

You must be at least 13 years old to create an account. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.

Some features are for adults (18+) only: cash rewards and payouts, and personalized ads. Accounts aged 13 to 17 can buy premium characters; on the web a parent or guardian completes the payment. Party voice chat is open to accounts aged 13 or over. We use the age you give us to decide what you can use.

You may not use Pixeltron if you are barred from doing so by law, or if we have closed your account before.

Your account

Give accurate information and keep it up to date. Keep your sign-in secure; you are responsible for what happens on your account.

One person per account. Do not sell, share or transfer your account, or use someone else's.

Tell us at support@pixeltron.ai if you think someone else has accessed your account.

What Pixeltron provides

Pixeltron lets you play games, make and publish games, join friends in parties and voice chat, earn Coins, and, where available, earn cash rewards.

We keep improving Pixeltron, which means features can change, be added, or be removed. Some features may be marked as early access or coming soon.

Playing on Pixeltron is free. Some features may need a paid plan or a purchase when they become available.

Your content

You own the games, art, text and other content you create ("your content").

So we can run Pixeltron, you give Pixeltron a worldwide, non-exclusive, royalty-free license to host, store, copy, run, display, adapt (for example to resize or translate), distribute and promote your content on Pixeltron and in connection with it, including in previews, share cards and ads for your game or for Pixeltron. The license lasts while your content is on Pixeltron and for a reasonable time after you remove it, and as long as we need to keep it for legal, safety or record-keeping reasons. Players who already have a copy of something you shared, such as a game in their library, may keep using it on Pixeltron.

You confirm you have all the rights needed for your content, including for anything you upload, reference or ask our AI to make, and that your content follows these Terms.

Pixeltron's content

Pixeltron owns the platform, its software, tools, game engines and runtimes, its brand, and the content we make. Making a game on Pixeltron does not give you ownership of Pixeltron's technology. You may use Pixeltron's content only as these Terms allow.

If you send us feedback or ideas, we may use them without owing you anything.

Rules for everyone

Follow the User Content and Community Policy. In short, do not: break the law or help others break it; harass, threaten, bully or hate on others; post sexual content involving minors, or any sexual content where it is not allowed; use someone else's work, name or likeness without permission; cheat, exploit bugs, use bots, or interfere with games, rewards or ads; try to break into, overload, reverse-engineer or get around the security of Pixeltron; send spam, scams or malware; or create accounts to get around a ban or a limit.

Games on Pixeltron run in a protected sandbox. Do not try to get a game to reach outside it.

Creators

If you publish a game, the Creator Terms also apply. You decide when your game is published, and you are responsible for it.

Coins, Studio Credits and rewards

Coins are a free in-app currency. They have no cash value, cannot be bought, sold or withdrawn, and never become money.

Studio Credits pay for AI tools such as image, 3D, video and audio generation. They have no cash value, cannot be transferred, and are not refundable except where the law requires.

Cash rewards, where available, follow the Rewards, Credits, and Payout Terms. We never pay cash for watching ads. Estimates are not earnings.

We may change how Coins, Studio Credits and rewards work, for example how many you earn or what they buy, and we may cancel them if they were earned by mistake, fraud or breaking these Terms.

Purchases and subscriptions

Paid plans and purchases are coming soon. When they open, these rules apply.

Prices are shown before you buy, including any tax where it applies. Purchases on the web are processed by our payment provider; purchases in the apps go through the Apple App Store or Google Play under their terms.

Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time; you keep access until the end of the period you paid for. We will tell you before a price changes, and the new price applies only from your next renewal.

Except where the law requires otherwise, payments are not refundable and there are no refunds for part of a period. If you are in a country that gives you a right to cancel a purchase, you agree that digital content and services start immediately and that this right ends once they do.

AI features

Pixeltron's AI can help you build games, make images, sound and video, and answer questions. AI output can be wrong, incomplete or similar to someone else's work. Check it before you rely on it or publish it; you are responsible for how you use it.

Do not use AI features to make content that breaks these Terms, and do not enter passwords, payment details or other people's private information.

Ads

Pixeltron shows ads to keep playing free. Ads appear only at natural breaks and in clearly labelled places, never in the middle of play. The Privacy Policy explains how ads use your information.

Other services

Pixeltron links to or works with services we do not run, such as sign-in with Google or Apple, payment providers and app stores. Their own terms apply, and we are not responsible for them.

Moderation, suspension and closing accounts

We may review, hold, limit, remove or restore content, and we may limit, suspend or close accounts, to keep Pixeltron safe, legal and fair or when these Terms are broken. Where we can, we tell you why and how to appeal.

You can close your account at any time in Settings. When an account is closed, purchased items, Coins and Studio Credits are lost, and any cash balance is handled under the Rewards, Credits, and Payout Terms.

Sections that by their nature should continue after an account closes (for example your license to us for published content, the limits of our liability, and how disputes are resolved) continue.

Disclaimers

Pixeltron is provided "as is" and "as available". As far as the law allows, we make no promises that it will always be available, error-free or secure, or that games and content made by others are accurate, safe or suitable. Nothing in these Terms limits rights you have by law that cannot be limited.

Limits on our liability

As far as the law allows, Pixeltron is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim is limited to the greater of US$100 or the amount you paid Pixeltron in the 12 months before the claim.

Some places do not allow these limits; where that is so, they apply only as far as the law allows.

Indemnity

If you use Pixeltron for a business, or your content or conduct breaks these Terms or the law, you agree to cover Pixeltron's reasonable costs, including legal fees, from claims by others that result from it.

Disputes

Talk to us first: most problems can be fixed by emailing support@pixeltron.ai. If a dispute is not resolved within 60 days, either of us may start a formal claim.

These Terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law rules.

Arbitration. Disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either of us may bring a claim in small-claims court, and either of us may go to court over intellectual-property rights. Arbitration can take place online or by phone.

No class actions. Claims may be brought only individually, not as part of a class, collective or representative action.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@pixeltron.ai with your account email and the words "arbitration opt-out". If you opt out, or if arbitration does not apply, disputes go to the state or federal courts in Delaware.

If you live in the European Union, the United Kingdom or another place whose consumer law gives you the right to bring a claim in your own country's courts, nothing here takes that right away.

Changes to these Terms

We may update these Terms. For important changes we will tell you in the product or by email before they take effect, and may ask you to accept them to keep using your account. If you do not agree, you can close your account.

General

These Terms are the whole agreement between you and Pixeltron about Pixeltron. If part of them cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of assets. We are not responsible for delays caused by events outside our reasonable control. These Terms are written in English; translations are for convenience, and the English version governs.
